Appeal from a judgment upon a verdict and order denying a new trial.

This action was brought to recover damages for alleged failure of defendants to deliver to plaintiffs certain goods sold to them. The issue was made upon the denial of such sale or claim therefor. The answer sets up as a separate defense, that the formalities, necessary under the Statute of Frauds, had not been complied with upon the alleged agreement and sale.
