LOWELL, District Judge.
The respondent in this case was incorporated as a “common carrier of property or persons.” Some of its officers testified that a large part of its business was the buying and selling of horses, hay, grain, wagons, harnesses, etc., and that most of its business was outside the usual business of a common carrier. An examination of the books, which were not produced before the referee, leaves little weight in this testimony.
