Judgment, Supreme Court, New York County, rendered January 16, 1975, upon a jury verdict, convicting defendant of grand larceny in the third degree, reversed on the law and in the interest of justice and the case remanded for a new trial. The People’s case consisted primarily of testimony by a cabdriver who asserted that defendant instead of paying the fare, forcibly stole $30 while displaying and threatening the use of a knife. During the course of the People’s presentation, defense counsel moved to have a statement, purportedly made by defendant in the presence of certain police officers…
