In this patent infringement action, following a so-called Markman proceeding, I construe as a matter of law the disputed claims of the subject patents.

The patents at the center of this dispute, U.S. Patent No. 6,696,088 (“the '088 patent”) and its continuation, U.S. Patent No. 7,658,939 (“the '939 patent”), are both entitled “Tamper-Resistant Oral Opioid Agonist Formulations” and owned by the defendant, Purdue Pharma L.P.
