*869The plaintiffs allege that they were sitting in their vehicle which was parked at a gas station owned by Getty Properties Corp. and Getty Petroleum Marketing, Inc. (hereinafter together Getty), and leased to M&T Mini Mart Corp. (hereinafter M&T), when Michael Maier lost control of his vehicle, left the roadway, entered the gas station, and struck their vehicle. The plaintiffs commenced action No. 1 against Maier. On December 9, 2008, the plaintiffs commenced action No. 2 against Getty and another entity, which the plaintiffs erroneously assumed was the lessee of the premises. In March 2009…
