Hill v. Cronin
West Virginia Supreme Court
Appeal from Circuit Court, Ritchie County. Bill by B. F. Hill, sheriff, against J. B. Cronin and others. Decree for plaintiff, and defendants appeal.
1Opinion of the Court
Miller, Judge:
The first question which confronts us, is one of jurisdiction. Have we the right to hear and determine the alleged errors of the circuit court, appearing in the record? Is the decree com-plained of an appealable decree? Code, chapter 135, section 1, *175gives the right to an appeal for error in a case where the matter in controversy, exclusive of costs, is of greater value or amount than.one hundred dollars, wherein there is a final decree or •order: or, in any case in chancery, wherein there is a decree or order, adjudicating the principles of the cause.
