RUDDY, Presiding Judge.

Plaintiff brought this action seeking a recovery of benefits allegedly due on a life insurance policy. The Circuit Court sustained defendant’s motion for summary judgment and denied plaintiff’s motion for summary judgment. Plaintiff appealed from the judgment entered. However, plaintiff in his brief states that he does not wish to prosecute the appeal from that part of the order denying his motion for summary judgment.
