Motion to strike from the abstract certain assignments of error, the point involved being the proper construction of 'section 569 of the civil code of 1909, relating to appeals. Plaintiff sued to recover for alleged breach of contract and-the jury returned a verdict for the defendant on which the court rendered *973judgment against the plaintiff for costs, from which plaintiff appeals.
