Defendant was indicted for the murder of Manuel Monis. He was tried before a judge sitting without a jury who found him guilty of voluntary manslaughter (Ill. Rev. Stat. 1967, ch. 38, sec. 9—2), and sentenced him to a term in the penitentiary of from three to ten years.
Defendant appeals that conviction and urges this court to reverse upon the following bases: (1) The State failed to prove beyond a reasonable doubt that when the defendant shot the deceased he was unreasonable in his belief that he was in danger of death or great bodily harm.
