PRATT, District Judge.

I.(a) This is an action of an equitable nature wherein the plaintiff, the owner of a placer mining claim known as the Spot Association, in the Innoko Precinct, Division aforesaid, prays that the defendants be restrained from causing the completion of a bridge and the construction of approaches thereto upon his said placer mining claim.(b) The cause was submitted to the Court upon an agreed statement of facts, which showed the following:
