(after stating the facts). The first assignment of error is that the judgment should he reversed because the court gave instruction No. 1, which is as follows :
‘If you find from the evidence that Wenatchee Produce Company loaded the car of apples in controversy at Cashmere, Washington, and took bill of lading subject to their own order and that the car was shipped February 13, 1918, to Kansas City, and if you further find that Charles H.
