This appeal arises out of a case involving an allision 1 between a United States Army Corps of Engineers (“USACE”) vessel and a private yacht, the Marquessa, owned by F.C. Wheat Maritime Corp. (“Wheat Maritime”) and operated by its parent company Wheat International Communications Corp. (“Wheat International”).
