The indictment under which this appellant was tried, convicted, and sentenced to-serve imprisonment in the penitentiary for an indeterminate term of from three and one-half to four years, Code. 1928, Sec. 5161, was, omitting the parts not material to our remarks, in words and figures as follows, to-wit: “The Grand Jury of said County charge that, before the finding .of this indictment that Ernest L.
