Appeal from an order of the Supreme Court (R. Sise, J.), entered April 2, 2012 in Saratoga County, which denied defendant’s motion for summary judgment dismissing the complaint.
*1294In November 2007, defendant, the driver of a dump truck with a trailer, was proceeding southbound around a sharp curve on a two-lane road, in the Town of Florida, Montgomery County, when he encountered a northbound car in which Corey Martin was a passenger.
