Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent denying petitioner’s application for accidental disability retirement benefits.
Petitioner, a police officer, applied for accidental disability retirement benefits following a December 12, 2010 slip and fall. The fall occurred on the street after petitioner exited a residence where she had been called to respond to a domestic incident.
