In a proceeding pursuant to CPLR article 78 to review a determination of the respondent Commissioner of Health of Rockland County, dated February 14, 1990, which assessed civil penalties of $1,800 upon the petitioners for violation of the Rockland County Sanitary Code, the appeal is from so much of a judgment of the Supreme Court, Rockland County (Carey, J.), dated October 12, 1990, as reduced the penalties imposed.
Ordered that the judgment is reversed insofar as appealed from, on the law, with costs, and the penalties are reinstated.
