*392Petitioner, Aaron Felix, applies for a writ of habeas corpus stemming from an order of the Fourth Judicial District Court entered on May 27, 1981. This order revoked a three-year deferred sentence given petitioner on May 22,1978 and imposed a three-and-one-half year sentence at the Montana State Prison upon peitioner.

Petitioner was convicted of theft, a felony, in the District Court of the Fourth Judicial District, Missoula County. On May 22,1978, he was given a three year deferred imposition of sentencing on the condition that restitution be made.
