Appeal by Frederic IT. Shonnard, one of the commissioners of appraisal, from so much of an order of the Supreme Court, made at the Westchester Special Term and entered in the office of the clerk of the county of Westchester on the 18th day of November, 1896, as removed him from the position of commissioner of appraisal in the above-entitled proceeding.

1Per curiam

The appellant was appointed in this proceeding a commissioner of appraisal for lauds of Cornell Dam by an order of the Supreme Court, dated March 7,1894, and took the oath of office and entered upon the discharge of his duties as such commissioner on March 17, 1894. His co-commissioners were Hon. Martin J. Keogh and James W. Boyle. At the general election held in November, 1895, Mr. Keogh was elected to the office of justice of the Supreme Court and entered upon the discharge of the duties of his office on January 1, 1896.
