We are here concerned with the question of whether the evidence supports a judgment for the respondents in the amount of twelve thousand five hundred dollars for attorneys’ fees.

The respondents had previously been before this court contending that, by the terms of an express contract, they were entitled to 125,000 shares of stock of the appellant, Slate Creek Mining Company, for legal services rendered to that company subsequent to November 5, 1940, by Edmund Paul Twohy, now deceased, and Frank Funkhouser.
