This proceeding was instituted in the county court of Multnomah County by John Bigne against the personal representative and the legatees under the will of Pierre Manciet, deceased. A copy of Manciet’s will is set out in Palicio v. Bigne, 15 Or. 142. Since the death of Manciet’s widow, Petra Cortez, John Bigne has acted as *363sole executor of said will; but on the twenty-fourth day of May, 1887, the county court of said Multnomah County appointed John B.
