On February 8,1954 the relator was convicted of book-making in violation of section 986 of the Penal Law, in the Court of Special Sessions of the Town of Brookhaven. He was sentenced to pay a fine of $500 and to serve a term of six months in the county jail, the execution of which jail sentence was suspended “ on the representation by the defendant that he would *822not again be involved in such activities ”. On October 1, 1954, in the Patchogue Village Police Court he was again convicted of book-making.
