This appeal concerns the validity of certain absentee ballots cast during a special general election for two seats on the Albany County Legislature.
In April 2003, the Albany County Legislature’s redistricting plan was challenged in federal court. As a consequence of the litigation, the Albany County Board of Elections was enjoined from conducting the primary and general elections for particular districts of the Albany County Legislature that had been scheduled for fall 2003.
