MEMORANDUM OPINION AND ORDER
RICHARD H. KYLE, District Judge.
This is an employment-discrimination action brought by Plaintiff James Arens against his former employer, Defendant O’Reilly Automotive, Inc. (“O’Reilly”). The case comes before the Court in a somewhat unique procedural posture.2
Arens commenced this action on February 27, 2012, in the Mower County. Minnesota District Court, naming as Defendants O’Reilly and his former supervisor, Defendant Rob Pocklington.
