Tbis cause coming on to be beard upon an appeal from the judgment of the clerk of the Superior Court, upon the motion of the defendant to set aside the judgment by default before the clerk and the verdict and judgment upon the inquiry of damages rendered before his Honor, J. Loyd Horton, judge, and a jury, at the May Term, 1923, of Lee Superior Court, and plaintiff through his counsel, having entered a special appearance and moved to dismiss the said appeal for the reason that the clerk did not have jurisdiction and was without authority to hear a…
