Petition for a writ of mandate to compel the respondent, treasurer of Santa Cruz County, to pay the coupons of certain railroad bonds issued by the county. The facts are stated in the opinion of the court.

By an act approved April 4, 1870, the legislature authorized the several counties of this State to aid (under certain conditions and qualifications) in the construction of railroads by the issue of county bonds payable within twenty *304years, and bearing interest not to exceed seven per cent per annum.
