APPEAL from the Circuit Court for Booh County. The facts are stated in the opinion. In each case the circuit court sustained the validity of the assignment and rendered judgment accordingly in favor of the garnishee. The plaintiff appealed. It was stipulated that one appeal should bring up all the questions involved in both cases.

The appellant brought its action in the circuit court of Rock county upon a bill of exchange, bearing date October 6, 1883, made by the Rock River Paper Company, payable to the order of Hinman, Moody & Co., for the sum of $620.10, at fifteén days’ sight, which was indorsed by Hinman, Moody & Co. to the appellant. In this action Hinman and others and the Rock River Paper Company were joined as defendants under the provisions of sec. 2609, *337E. S. 1878.
