Growing out of a controversy between the appellants, composing the real estate firm of Mead & Coe, and the appellee, Cleland, wherein it was charged by Cleland that an employe of Mead & Coe had wrongfully retained and appropriated to his own use, in a certain real estate transaction, §3,075, which rightfully belonged to Cleland, it was agreed between the parties that Mead & Coe should deposit their check on the Eoyal Trust Company Bank for that sum, with the Northern Trust Company, to hold as an escrow pending such reasonable time as might be necessary to investigate the charge, and to…
