Plaintiff, Robert Bishop, brought this medical malpractice suit against Dr. Samuel T. Baz, Bishop’s family doctor, in August 1984, after his left foot was partially amputated. Subsequently, both of plaintiff’s legs were amputated below the knee. The matter proceeded to a jury trial in June 1989, which resulted in a verdict for the defendant doctor. Judgment was entered on the verdict. Plaintiff then moved for judgment notwithstanding the verdict and for a new trial. On January 24, 1990, the court granted plaintiff a new trial.
