MEMORANDUM OPINION AND ORDER

BEFORE THE COURT are the cross-motions for summary judgment filed by Plaintiff [31] and Defendant [23, 25], Both parties assert that they are entitled to judgment as a matter of law as to the last remaining issue in this case: whether the Education Employment Procedures Law of 2001, Miss.Code Ann. §§ 37-9-101, et seq. (“EEPL”) applies to Plaintiffs head basketball coach contract with the Defendant.
