The petition for a judgment annulling the respondent’s determination of December 18, 1986, which decided that petitioner’s retirement application was received by the Comptroller one day too late to permit him to be eligible for the early retirement incentive credit offered by his employer, and declaring that he is entitled to the benefit of Laws of 1986 (ch 177), will be granted, without costs. Laws of 1984 (ch 665) authorized employers participating in the New York State Retirement System to offer their employees an early retire*588ment incentive program.…
