In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Kings County (Solomon, J.), dated May 31, 2012, which, upon the granting of the defendants’ motion pursuant to CPLR 4401, made at the close of the plaintiffs case, for judgment as a matter of law dismissing the complaint, is in favor of the defendants and against him dismissing the complaint.
Ordered that the judgment is reversed, on the law, with costs, the defendants’ motion pursuant to CPLR 4401 for judgment as a matter of law dismissing the complaint is denied, the complaint…
