Defendant-appellant, Edward F. Wilkinson (Wilkinson), appeals his battery conviction and sentence. After a bench trial, the court sentenced him to a one-year conditional discharge, a $500 fine, and prohibited him from having any contact with the complaining witness.

On appeal, Wilkinson argues that (1) the evidence was insufficient to prove him guilty beyond a reasonable doubt; (2) there was a prejudicial variance between the charge and proof at trial; (3) the trial court erred in denying motions for a new trial and in arrest of judgment; and (4) the trial court erred in failing to sentence…
