ON MOTION TO REINSTATE APPEAL.

DAVIDSON, Judge.

A proper appeal bond now appearing, as shown by supplemental transcript, this appeal is reinstated and the case is now considered on its merits.

Brewer, the injured party, was a truck operator. About seven o’clock on the evening of January 2, 1945, he went to a pool hall in the City of Amarillo to play pool, parking his truck nearby. In the pool hall he met and made the acquantance of appellant, and another man whom he designates in this record as “Shorty.” With these he played a few games of pool and drank some beer.
