ALTIMARI, Circuit Judge:
The sole issue raised on this appeal concerns the requisite standard of proof to establish “relevant conduct” under the Sentencing Guidelines. Defendant-appellant Ricky Guerra appeals a judgment of the United States District Court for the Southern District of New York (Charles S. Haight, Judge) that imposed a sentence on him pursuant to the Sentencing Reform Act of 1984, as amended, 18 U.S.C. § 3551 et seq. and 28 U.S.C. §§ 991 et seq. Defendant was charged in a two count indictment, and pled guilty to Count I, distributing crack in violation of 21 U.S.C. §§ 812,…
