Tort, for personal injuries occasioned to the plaintiff, by reason of an alleged defect in the sidewalk of a street in the defendant city. At the trial in the Superior Court, before Richardson, J., the jury returned a verdict for the defendant; and the plaintiff alleged exceptions, which appear in the opinion.

On December 11, 1894, at six o’clock in the evening, the plaintiff fell upon a sidewalk, and was injured. The testimony introduced on the part of the plaintiff, on the question of her due care, tended to show “that just before she fell she was walking as she usually walked, and was looking straight ahead towards Park Street, the direction in which she was going.” On the question whether there was a defect in the street, the evidence tended to show that there had been a snowstorm two days before the accident, and it was in,dispute *479whether the sidewalk had been cleared, or whether a ridge of…
