Memorandum: Defendant appeals from a judgment convicting him upon his plea of guilty of manslaughter in the first degree (Penal Law § 125.20 [1]). Contrary to the People’s contention, the record contains no waiver by defendant of the right to appeal, although we note that County Court indicated at the commencement of the plea proceeding that it assumed that the plea bargain included such a waiver.
