APPEAL from the Ripley Circuit Court.

—This was an action brought by the appellee, Eric M. Graydon, against the appellants to recover the possession of the undivided half of real estate in Ripley county.

The appellants answered by a general denial, and also a *560paragraph setting up the proceedings in the court of common pleas of Decatur county for the sale of the said land on the petition of the administrator of the estate of Gustavus B. Graydon, deceased.

To the last paragraph a demurrer was filed and sustained, to which exceptions wa taken.
