The appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life, and from this judgment he prosecutes this appeal. The record contains what purports to be a statement of facts in the case. No file mark appears on the statement of facts, and we are not informed when it was filed.
