HEALY, Circuit Judge.
Appellant was convicted of a violation of 18 U.S.C.A. § 75311.1 The indictment charged that the accused, being a person committed” to the custody of the Attorney General of the United States and his authorized representative, namely, the warden of the United States penitentiary at Alcatraz Island, did on or about July 31, 1945, attempt to escape from custody.
