This was an action of replevin brought by Emil Werner against M. A. Bergman, to recover certain goods and chattels used by the defendant in keeping a restaurant. The facts of the case appear to be substantially as follows: On July 2, 1879, Mrs. M. A. Bergman was keeping a restaurant in Wichita, Kansas. On that day she borrowed some money of the plaintiff, Werner, and gave her promis*61sory note therefor.
