The plaintiff in error, hereinafter referred to as the defendant, was convicted of possession of beer, the same containing in excess of one-half of 1 per cent, alcohol by volume, with the unlawful intent to barter, sell, give away, or otherwise furnish to others; and was sentenced to pay a fine of $50 and to be imprisoned in the county jail for thirty days; from which judgment the defendant has appealed.
