WELLBORN, District Judge.

This is a suit for an accounting as to transactions had under a contract, of which the following is a copy:

“This agreement, made this eighth day of Sept.. 1885, by and belween Wm. H. Patten, Norman Stafford, and John E. Myer, all of Canastota, in the state of New York, co-partners under firm name of Patten, Stafford and Myer, doing business in said Canastota, and Charles A. Whittemore, of Melrose, Massachusetts, witnesseth: That said Patten, Stafford and Myer, in consideration of the promises of said Whittemore hereinafter set forth, do hereby appoint said Whittemore…
