OPINION

JULIAN, Senior District Judge.

This action is brought pursuant to 42 U.S.C. § 1983 (1970) to redress alleged violation of rights secured by the Constitution of the United States. Plaintiff seeks compensatory and punitive damages and a declaration that M.G.L. c. 71, § 42D, particularly the second paragraph thereof, 1 and actions of the defendants pursuant thereto are unconstitutional. Plaintiff waived his demand for injunctive relief at the pre-trial conference on April 1, 1974. Jury trial having been waived, this case was tried by the Court.
