This action is before this Court upon an appeal from a final order of the Circuit Court of Kanawha County entered on November 7, 1996. The circuit court denied a petition for writ of habeas corpus filed by the appellant, James McClure, seeking to have his convictions of first degree murder and malicious wounding reversed on the basis of alleged fraudulent testimony provided at his trial by former State Trooper Fred Zain.
