Tbe Atlantic Coast Line Railroad excepts upon tbe ground that tbe Montgomery Lumber Company Railroad is not such a common carrier that tbe Corporation Commission bad authority to establish and compel tbe putting into effect joint rates between it and tbe A. C. L. Railroad.

In this case tbe joint rates are established for only one commodity, crushed stone, etc., a product of tbe Raleigh Granite Company’s plant near Rolesville.' Tbe Corporation Commission, 21 March, 1916, upon tbe application of said Montgomery Lumber Company, authorized it to carry freight and passengers and charge therefor,…
