ARABIAN,J.

—Defendant Ronald Lee Deere was convicted of one count of first degree murder and two counts of second degree murder, accompanied by a finding of a multiple-murder special circumstance (Pen. Code, *711§ 190.2, subd. (a)(3)).1 The penalty was fixed at death. The penalty judgment was subsequently reversed by this court in People v. Deere (1985) 41 Cal.3d 353 [222 Cal.Rptr. 13, 710 P.2d 925] (Deere I). Following a remand for retrial of the penalty phase, the sentence was again fixed at death. This appeal is automatic. (§ 1239, subd. (b).)
