The appellant, Veil Keith Smithers, filed a petition for a writ of habeas corpus on August 17, 1961, against William Bind-ner, Chief of Police of Louisville, in which he prayed that he be discharged from unlawful restraint and custody. The petition charged that on that day he had been arrested by Louisville police officers upon a warrant of arrest issued by the Governor of Kentucky in a proceeding by which the State of New York was attempting to extradite the petitioner.
