*1388Appeal and cross appeal from an order of the Supreme Court, Erie County (Patrick H. NeMoyer, J.), entered October 21, 2014. The order, among other things, granted the motions of plaintiff and defendant Executive Security Management, Inc., doing business as The Apex Group, for leave to reargue and, upon reargument, the court adhered to its prior determination.
