This action in assumpsit was tried in the Superior Court before a jury and resulted in a verdict for the plaintiff in the sum of $4,049.81. Thereafter defendant’s motion for a new trial was granted and the case is here on plaintiff’s exceptions as follows: to rulings during the course of the trial, to the denial of its motion for a directed verdict, to portions of the charge to the jury and to the granting of defendant’s motion for a new trial.
