MEMORANDUM OF DECISION

PIESTER, United States Magistrate Judge.

In this action Douglas Rader, an eighteen-year-old freshman student at the University of Nebraska-Kearney (“UNK”), alleges that UNK’s parietal rule, which requires on-campus residency of freshman students, runs afoul of the First Amendment to the United States Constitution.
